Waiting period
Upon expiry of an assignment contract, it is not permissible, in order to fill the post of the worker whose assignment contract has come to an end, to employ the same worker or another worker recruited on the basis of a fixed-term contract or a hiring-out contract arranged by a temporary work agency operator before the expiry of a period equal to one-third of the duration of that contract, including any renewal.
Cases where the waiting period is not required
A waiting period is not necessary:
- in the event of renewed absence of the replaced employee;
- in the event of execution of urgent work;
- in the case of seasonal contract ;
- in the case of a contract intended to fill a post for which the consistent practice is not to have recourse to a contract of indeterminate duration;
- in the event of premature termination by act of the worker working under an assignment contract;
- in the event of refusal by the worker to renew his contract, where the latter includes a renewal clause, for the period of the unrenewed contract still to run.
