D7a9 - What measures should be taken by an employer if a pregnant or breastfeeding woman is working in a dangerous post?

The employer is subject to a reporting obligation vis-à-vis any pregnant or breastfeeding employee employed in his company.

That reporting covers:

  • a list of all jobs which pregnant or breastfeeding women cannot be required to perform, in accordance with the legal provisions;
  • identification of the measures taken to eliminate any risk to the health and safety of such women;
  • the elimination of the possible impact of any risk on pregnancy or breastfeeding.

The employer is subject to an obligation:

  • to evaluate the nature of the risk and the degree of risk associated with the list in Annex 1 of the Labour Code and the risks of exposure to substances or working conditions referred to in Annex 2 of the Labour Code;
  • to assess the risk and its repercussions;
  • to take action to determine the measures to be taken to counter that risk.

In order to fulfil his obligations, the employer must work in collaboration with the competent occupational doctor.
