D7a11 - What measures are to be taken if a pregnant or breastfeeding woman is working in a dangerous post?

For the 1st category of activities, protective measures are only required to be taken if a risk to health is ascertained by the occupational doctor.

For the 2nd category of activities, a mere risk of exposure associated with tasks is sufficient to trigger the protection mechanism.

The protective measures to be taken by the employer are as follows:

  • for activities in the 1st category: the employer must first endeavour to eliminate the risk to health by making adjustments to the work post. If that is not possible, he must transfer the woman concerned to another work post. If no post is available, he must grant an exemption from work;
  • for activities in the 2nd category, the employer must forthwith assign the woman to another work post and, if there is no post, grant an exemption from work.

If she is exempted from work, the pregnant or breastfeeding employee will receive a pecuniary maternity allowance from her sickness fund.
