D5f6 - Must the WOP be submitted to the staff committee or the employees concerned for their opinion?

Yes.

Every work organisation plan (WOP) must be submitted in advance to the competent staff committee for it to give its opinion on it or, if there is no committee, to the staff concerned, no later than 5 days before the entry into force of the WOP.

If the committee or, if there is no committee, the employees concerned do not agree, expressing in writing a negative and duly reasoned opinion regarding the WOP, the more diligent party may refer the dispute to the Director of the ITM or his delegate, who will endeavour to find an agreement between the parties within a month of the reference to him.

If that attempt fails and the disagreement persists, duly noted by the Director of the ITM, the dispute may be brought by the more diligent party before the National Conciliation Office (ONC) in accordance with the rules of that Office.

The reference to the ITM or to the ONC does not suspend the implementation of the contested WOP.
