D1a7 - What particulars must be set out in the employment contract?

  • the identity of both parties;
  • the starting date of implementation of the employment contract;
  • the place of work or the principle that the employee will be employed at various locations;
  • a description of the tasks and functions assigned to the employee;
  • the daily working time or the weekly working time of the employee;
  • the normal work schedule;
  • the wage or basic salary and, where appropriate, additions to wages or salary, incidental payments, agreed bonuses or profit-sharing, as well as the frequency of payment of the remuneration to which the employee is entitled;
  • the duration of paid annual leave or the method of calculating paid leave; (*)
  • the length of the notice periods to be observed by the employer and the employee in the event of termination of the contract; (*)
  • the possible duration of a probationary period;
  • any derogations or additional clauses which the parties have agreed upon;
  • an indication of any collective agreements governing the employee's working conditions;
  • where applicable, the existence and nature of a supplementary pension scheme, the compulsory or optional nature of that scheme, the rights to related benefits and the possible existence of personal contributions.
