D2b9 - What other provisions of the Labour Code also apply to pupils and students?

All legal, regulatory, and collective agreement provisions concerning working conditions and employee protection apply, including:

  • The provisions of the Labour Code relating to the protection of young workers;

  • Protection for pregnant, postpartum, and breastfeeding employees;

  • Pre-employment medical examinations (only for pupils and students, provided that they are performing work in a hazardous position as referred to in Article L. 326-4 of the Labour Code);

  • Protection against harassment and violence, as well as ionizing radiation.

Nota Bene

Exceptions:

  • Paid recreational leave
    The employment of pupils and students does not entitle them to paid recreational leave.

  • Extraordinary leave for personal reasons
    Extraordinary leave must be granted in the cases provided for by law, but no compensation is due during such absences.

  • Illness
    Pupils or students are not entitled to remuneration during periods of absence due to illness. Moreover, the employment of pupils and students is not subject to health insurance.

  • Work on Sundays or public holidays
    Pupils and students over the age of 18 who are employed during school holidays may work on Sundays or legal public holidays.
    By exception, adolescent pupils and students (aged 15 to 18) employed during school holidays may also work on Sundays or legal public holidays.
