Maternity leave is made up of prenatal leave AND postnatal leave.
Prenatal leave
A pregnant employee may not be employed during the 8 weeks preceding the expected date of delivery.
Such prenatal leave must be evidenced by a medical certificate indicating the expected date of delivery.
If delivery takes place before the expected date, the days of prenatal leave not taken will be added to the postnatal leave.
If the delivery takes place after the expected date, the prohibition of employing the pregnant woman will be extended until delivery, and the duration of the postnatal leave may not be reduced.
Postnatal leave
A woman who has given birth may not be employed during the 12 weeks following delivery.
The said postnatal leave must be evidenced by a medical certificate indicating the date on which she gave birth.
