D2b4 - What are the details which must be included in a student contract?

This contract must include:

  • the last name, first name, date of birth, and home address of the pupil or student;

  • the last name, first name, and address of the employer, or if the employer is a legal entity, the company name and registered office;

  • the start and end date of the contract;

  • the nature of the job and, where applicable, a description of the functions or tasks assigned to the pupil or student at the time of hiring, as well as the place of work or, in the absence of a fixed or predominant workplace, the principle that the pupil or student will work in various locations, particularly abroad, or will be free to determine their workplace, as well as the registered office or, where applicable, the domicile of the employer;

  • the daily and weekly working hours, and terms related to overtime work and its remuneration, as well as, where applicable, all terms relating to shift changes (*);

  • the agreed salary, taking into account the provisions of Article L. 151-5 and, where applicable, all salary supplements, benefits, bonuses, or profit-sharing agreements, which must be specified separately (*);

  • the time and method of salary payment (*);

  • the place where the pupil or student is housed, if the employer has agreed to provide accommodation;

  • the procedure to be followed by the employer and the pupil or student in the event of termination of the employment contract, including any required formalities (*);

  • the identity of the social security institution(s) receiving the contributions and the related social protection scheme (*);

  • where applicable, reference to the collective agreements governing the working conditions applicable to the pupil or student, or, in the case of collective agreements concluded outside the company by joint bodies or institutions, the name of those bodies or institutions where the agreements were concluded;

  • where applicable, the right to training granted by the employer (*).

Some of these details, namely those marked with an asterisk (*), may be provided by referring to the legal, regulatory, administrative, or statutory provisions or to the applicable collective agreements governing those matters.

If one or more of the above-mentioned pieces of information have not been individually provided to the pupil or student within the required deadlines, and after the employer has been duly requested by the pupil or student to comply, the latter may, within fifteen days of the unheeded formal notice, submit a simple request to the president of the labour court. The president will rule urgently and summarily, after hearing or duly summoning the parties, and may order the employer, including under penalty, to provide the missing information to the employee. (Faq D2b4). 

Nota Bene

Any modification to the engagement contract by mutual agreement must be:

  • in writing;

  • in two copies; and

  • made at the latest by the time the modifications take effect.

The amendment document must be provided by the employer to the pupil or student:

  • either in paper format, or

  • in electronic format, provided that:

    • the pupil/student has access to it,

    • it can be saved and printed, and

    • the employer keeps proof of its transmission or receipt.
