D2a22 - Are the provisions relating to temporary work applicable to temporary work agencies established abroad and which post the temporary workers to Luxembourg territory?

The provisions concerning temporary work are applicable to the conclusion and performance by a temporary work agency operator established outside Luxembourg territory, of hiring-out contracts and assignment contracts whose purpose is to arrange for a temporary worker to be employed by a user company established on Luxembourg territory.

Thus, a temporary work agency established abroad which posts its temporary workers to a user company established on Luxembourg territory is required to hold a business permit and an authorisation to operate as a temporary work agency operator issued by the Minister of Labour.

However, a temporary work agency established abroad and whose temporary workers are posted to Luxembourg territory to a company governed by foreign law, that is to say which is established abroad and which uses temporary workers, does not need to hold the above-mentioned permit and authorisation to provide services in the Grand Duchy of Luxembourg.
