D4a6 - Does the disclosure of qualifications during the performance of a contract confer on the employee a right to the social minimum wage for skilled workers?

No.

An employee may not claim entitlement to the SSM for skilled workers if he did not produce, when recruited, a diploma attesting to his vocational training or if the employer had no knowledge of the employee’s qualifications.

The disclosure of a higher qualification during performance of the employment contract may at the most raise the question of entitlement to an increase of wage from that date.

Payment of a wage supplement does not accrue automatically to an employee who holds a diploma: the employer must also be informed of the qualifications of the employee whom he wishes to recruit.

It is incumbent upon the employee to prove that he informed his employer about his qualification at the time of his recruitment.
