A non-competition clause contained in an employment contract is one by virtue of which the employee undertakes, for a period following his departure from the undertaking, not to carry on activities similar to those of his employer, in order not to undermine the latter’s interests by operating a personal business. 

A non-competition clause does not cover the waged activities which the former employee carries out for a new employer; neither does it cover cases where the employee establishes a company, even if he is the sole manager, member or director.
