An employee who, at the end of the notice period or following a change having immediate effect, made in due and proper form, remains with his employer at the time of the entry into force of the change, without resigning immediately, is deemed to have accepted the change and cannot thereafter require the continuation of the earlier working conditions.
Provided he has not broken off his employment contract at the end of the notice period, an employee is deemed to have accepted his employment contract with new conditions and he cannot contest the merits of the change subsequently.
An employee who remains with his employer after the entry into force of the changes can therefore no longer resign thereafter in accordance with the special procedure available to him in such circumstances and attack the change.
Any reservations or protestations by the employee prior to and/or subsequent to the entry into force of the substantial change will be inoperative to the extent to which they are not accompanied by his resignation, the only procedure possible for an employee who does not accept a substantial change detrimental to him.
