An employer, as the only person subject to the risk arising from the business of his undertaking, has as a corollary the benefit of managerial authority.
The employer thus alone decides on the economic policy of the undertaking, its internal organisation and the technical arrangements for its operation, which he may adjust at any time at his discretion.
During working hours, the employee is subject to the employer’s managerial authority and may not refuse to perform the duties falling within the scope of his contractual obligations. The subordinate relationship ends after working hours.
The employer therefore has managerial authority provided that he does not breach, in particular, employment contracts, collective agreements and internal regulations; the employer is free to decide to whom he wishes to assign which responsibilities. The employee, for his part, will be obliged to refuse an unlawful order from his line manager.
