D1b7 - Can a fixed-term contract be renewed?

A fixed-term contract (CDD) can be renewed, i.e. extended, provided that the principle of renewal and/or the renewal conditions are laid down in a clause of the initial employment contract or in an addendum to that contract.

Examples

Renewal clause:

In case of need, the existing contract may be renewed on 2 occasions, provided that its total duration, including any renewal or renewals, does not exceed 24 months.

The fixed-term contract cannot be renewed more than twice, and its total duration (including the initial contract duration and renewal(s)) cannot in principle exceed 24 months.

In the event of renewal of the fixed-term contract, there must always be a reason justifying the use of the fixed term-contract (see FAQ D1b1).

Nota Bene

In the absence of such a renewal clause, the renewed CDD is regarded as concluded for an indeterminate duration.

The CDD may be renewed on 2 occasions for a specific period.

The duration of a CDD, including any renewal and probationary period, may not exceed 24 months.

A contract concluded for the specific duration of a season constitutes a CDD even if it is renewed for the following seasons.

A CDD may be renewed on 2 occasions for a specific period (hence a maximum of 3 CDDs).

The duration of a CDD, including any renewal, may not exceed 24 months.

A contract concluded for the specific duration of a season constitutes a CDD even if it is renewed for the following seasons.
