A fixed-term contract must include, in addition to the details required to appear in any employment contract, the following indications:
- a definition of its subject-matter, that is to say the precise and non-permanent task for the performance of which the employee was hired;
Examples
A fixed-term contract is concluded on account of a work overload in Department X following [...], the volume of orders [...]. It is a temporary phenomenon in so far as [...].
- where it is concluded for a specific period, the final date thereof (*);
- where it does not include a final date, the minimum period for which it is concluded (*);
- where it is concluded for the replacement of an absent employee, the name of the absent employee in the case where it is an indirect replacement of an employee absent due to parental leave, the contract will indicate the name of this employee, even if the replacement involves another position;
- the duration and terms of any probationary period provided for; and
- if appropriate, a renewal clause.
Nota Bene
If there is no written record specifying that the employment contract is entered into for a fixed period, the contract is regarded as concluded for an indeterminate period. Proof to the contrary is not permissible.
