The employment contract must be entered into no later than the time of the employee’s entry into service.
In the event of conclusion of the employment contract after the entry into service of the employee, the employment contract can only be for an indeterminate duration (CDI) and without a probationary period.
Thus, if the employee entered the service of his employer prior to the signing of the employment contract, the employment relationship will be considered to be of indeterminate duration and without a probationary period.
However, the employment contract may be concluded before the employee begins work. The contract will then contain the starting date of implementation of the employment contract.
