D1a3 - Must the employment contract be recorded in writing?

An employment contract, whether of indeterminate duration (CDI), or for a fixed term (CDD),
must be recorded in writing for each employee individually no later than upon the employee’s entry into service.

The contract must be signed by both the employer and the employee and drawn up in two original copies, one to be given to the employer and the other to the employee.

The employer must provide the contract to the employee:

  • In paper format; or

  • In electronic format, provided that:

    • The employee has access to it;

    • It can be saved and printed; and

    • The employer retains proof of its transmission or receipt.
