D2e26 - How to Respond if the Employer Fails to Pay the Apprenticeship Allowance

Faced with non-payment of the apprenticeship allowance, the apprentice must inform the apprenticeship advisor.

If no amicable settlement can be reached between the apprentice and the training employer, the apprentice must send the employer a formal notice demanding payment of the wages within a specified period (8 to 15 days).

The formal notice must be sent by registered letter.

If the employer has still not paid the wages upon expiry of the specified deadline, the employee may either file a complaint with the ITM (Inspectorate of Labour and Mines) or initiate:

  • Summary proceedings before the President of the Labour Court to recover outstanding wages;

or

  • Ordinary court proceedings before the Labour Court.
