D4e2 - What are the conditions for the validity of a receipt in full and final settlement?

A receipt in full and final settlement must include the following information:

  • an indication of the sums paid by the employer (e.g. arrears of wages, overtime, paid leave, severance pay, compensation in lieu of notice, etc.);
  • the fact that it has been drawn up in duplicate;
  • the words “for full and final settlement” written entirely in the employee’s handwriting and followed by his signature;
  • the foreclosure period of 3 months, in very clear characters.

Examples
“In accordance with Article L.125-5(2) of the Labour Code, this receipt in full and final settlement may be repudiated by a registered letter within 3 months following signature. The repudiation must include a brief statement of reasons and indicate the rights relied upon.”
