D6c5 - What are the implications of a progressive return to work for therapeutic reasons for the employee ?

A progressive return to work is considered as a period of total incapacity for work and will be counted as such when determining the end of entitlement to benefits (78 weeks within a 104-week period).

In the case of a progressive return to work for therapeutic reasons, the employer is therefore obliged to continue paying the employee’s full salary and other contractual benefits until the end of the calendar month in which the 77th day of incapacity for work occurs during a 12-month reference period. From the month following the 77th day of illness, the employee is fully covered by the Luxembourg National Health Fund (Caisse nationale de santé - CNS), both for the time spent working and the time not worked.
