Permission to leave home is always authorised for medical reasons, and therefore the employee may, during sickness leave, visit the doctor designated by the employer.
Also, the employee should not be obliged to allow the doctor sent by the employer to enter his private home.
It should also be noted that, following a change to the internal rules of the National Health Fund (CNS), regarding examination of persons who are ill, the following rules have been applicable since 1 October 2010:
- no exit from home is allowed during the first 5 days of incapacity for work;
- as from the 6th day of incapacity for work (for leaving home not counter-indicated by the attending physician), authorised times for leaving home are between 10 a.m. and noon in the morning and between 2 p.m. and 6 p.m. in the afternoon;
- essential exits from home to go to the Social Security Medical Board (CMSS), to the attending physician or to any other care provider are authorised at any time and are, where appropriate, to be documented by the person subject to monitoring.
