D1a6 - What should be done in the event of a refusal by either of the parties to sign the employment contract?

Where one of the parties refuses to sign the employment contract despite being asked to do so by the other party, the latter may terminate the contract of employment without notice or compensation.

Such termination without notice must however take place:

  • at the earliest, on the third day following the request that a document be signed; and
  • no later than 30 days after the employee’s entry into service.

After that period, any termination must comply with the general rules on the termination of employment contracts.
