D8a17 - Is the Employer Required to Keep a Register of Employees’ Statutory Annual Leave?

Yes.

The employer is required to keep a register of the statutory annual leave of all employees in their employment.

Officials of the Inspectorate of Labour and Mines (ITM) are also entitled to request access to the register or file for inspection.

This legal obligation on the employer means that, in the event of a dispute concerning the annual leave entitlement due to an employee, the burden of proof lies with the employer. The employer must provide this proof by producing the annual leave register that they are legally required to maintain.
