You have the right to access, modify, rectify, and delete personal data concerning you, as well as the right to object to the processing of your personal data.
In this context, you have the option to submit a complaint by post, electronically, or verbally to the Data Protection Service at the following address:
Inspection du travail et des mines, Service Protection des Données, L-2010 Luxembourg, P.O. Box 27, email: protection.donnees@itm.etat.lu.
To properly identify your complaint and respond to you effectively, the Inspection du travail et des mines (ITM) asks that you provide the following information:
- Your identity (ID card or passport);
- The personal data for which you are making a request;
- The circumstances under which the ITM obtained your personal data.
In the specific case of a request for rectification, deletion, or blocking of your personal data, the ITM requests that you specify the reasons why your data is incorrect, incomplete, or why you believe your data has not been processed in accordance with the data protection regulations.
Once the complaint is received, the ITM has a period of 4 weeks to respond in writing to your request:
- Indicating the actions that have been/taken or will be taken;
- Informing you of the period during which you will be notified of the actions taken, without exceeding a total period of 8 weeks.
This 4-week period may be extended in certain circumstances.
You have the option to file a second complaint directly with the ITM management if:
- The response provided is unsatisfactory;
- You did not receive a response within the aforementioned 8-week period.
You may also file a complaint with the supervisory authority, the National Commission for Data Protection (CNPD; L-4370 Belvaux, 15, Boulevard du Jazz), or file a judicial appeal.
No payment is required by the ITM for providing information under Articles 13 and 14 of the GDPR or for communicating and taking action under Articles 15 to 22 and Article 34 of the GDPR. When requests are manifestly unfounded or excessive, particularly due to their repetitive nature, the ITM may:
- Charge reasonable fees based on the administrative costs incurred in providing the information, making communications, or taking the requested actions, or
- Refuse to comply with such requests.
