A person wishing to work as a temporary work agency operator must obtain the following authorisations:
- an authorisation from the Minister of Labour, who gives his decision on the basis of an opinion from the Employment agency (ADEM) and of the Inspectorate of Labour and Mines (ITM); and
- an authorisation from the Minister whose terms of reference include the right of establishment.
The temporary work agency operator must without delay give notice to the user company of the date of any cessation of the authorisation; the same applies in cases of refusal of an extension and withdrawal of the authorisation.
Cases in which authorisations must be refused
Such authorisations must be refused:
- for the establishment on Luxembourg territory of a temporary work agency whose registered office or principal establishment is located outside the territory of the Member States of the European Union;
- if the person or persons responsible for the management of the temporary work agency do not present the necessary guarantees of honourability and professional qualifications.
