D3a1 - What is the purpose of a probationary clause in an employment contract?

A contract of indeterminate duration (CDI) or a fixed-term contract (CDD) may include a probationary clause.

The aim of the probationary period is to allow:

  • the employer to appraise the professional skills of the employee for the task entrusted to him; and
  • the employee to decide whether the work to be done is suitable for him and if it is in harmony with his expectations.
