The rules on remuneration for Sunday work do not apply to employees classified as senior executives.

Definition

Employees fulfilling both of the following conditions are regarded as senior executives:

  • they receive significantly higher remuneration than employees covered by a collective agreement or another scale, taking account of the time needed for the performance of their functions;
  • that remuneration is the quid pro quo for the exercise of genuine and effective managerial authority or where the nature of the tasks involves clearly defined authority, considerable independence in the organisation of work and wide-ranging freedom regarding work schedules and in particular the absence of timetabling constraints.
