Sunday work confers on employees the right to an increase of remuneration of 70% for each hour worked on a Sunday.
Employees working on a Sunday are entitled to compensatory rest corresponding to:
- a full day, if the Sunday work lasted more than 4 hours;
- a half day, if the Sunday work did not exceed 4 hours.
In cases of compensatory rest, only the supplement of 70% is due.
It should be noted that where work has not exceeded 4 hours, the compensatory rest must be granted before or after 1 p.m. and on that day the period of work may not exceed five hours.
If the hours worked on Sunday also constitute overtime, they will also be paid for on that basis.
Examples
An employee working full time works 4 hours on Sunday and those hours also constitute overtime.
- For an employee who is not granted compensatory rest and for whom overtime is remunerated, the employee is entitled:
- to payment for 4 hours Sunday work (100%);
- to payment of the increment for Sunday work (70%);
- to the overtime increment (40%).
- For an employee who receives compensatory rest and for whom overtime is remunerated, the employee is entitled:
- to paid compensatory rest (100%) of half a day (4 hours for a full-time employee);
- to payment of the increment for Sunday work (70%);
- to the overtime increment (40%).
- For an employee granted compensatory rest and for whom overtime is compensated for by paid rest time, the employee is entitled:
- to paid compensatory rest (100%) of half a day (4 hours for a full-time employee);
- to payment of the increment for Sunday work (70%);
- to remunerated rest time for 2 hours (0.5 or 50% of 4 hours, and not 1.5 of 4 hours).
Examples
A full-time employee works 2 hours on Sunday and those hours also correspond to overtime.
- For an employee who receives compensatory rest and for whom overtime is remunerated, the employee is entitled:
- to compensatory rest of a half day (4 hours), but remunerated at the rate of 2 hours;
- to payment of the increment for Sunday work (70%);
- to the overtime increment (40%).
Examples
An employee working for 10 hours a week works 4 hours on Sunday and those hours correspond to overtime.
- For an employee who receives compensatory rest and for whom overtime is remunerated, the employee is entitled:
- to compensatory rest of half a day (1 hour, on account of part-time work = ¼ of 4 hours, since the employee is working ¼ of 40 hours, full-time employee);
- to payment of the increment for Sunday work (70%);
- to the overtime increment (40%).
Young employees
For young employees, pay for Sunday work will attract a supplement of 100%.
Employees in the hospitality and catering industry
By way of derogation, Sunday work in hotels, restaurants, canteens, bars and other establishments where food and beverages are consumed (and also in agriculture and winegrowing) does not confer entitlement to an increase of remuneration.
In those companies, Sunday work entitles an employee who, over a period of a calendar year, works 20 Sundays, to at least 2 days of paid leave which are added to annual recreational leave
