The prohibition of Sunday work does not apply to:
- supervision of the premises allocated to the undertaking;
- cleaning, repair and maintenance work needed to ensure proper continuous operation;
- works other than those of production on which the regular resumption of operations the following day depends;
- works needed to prevent the deterioration of raw materials or products;
- urgent work, the immediate execution of which is necessary to organise safety measures, to prevent imminent accidents or to remedy the effects of accidents that have already affected equipment, installations or buildings of the company.
The latter derogation applies not only to employees of the company in which the urgent work is required but also to those of any other company carrying out repairs for the first-mentioned company.
The above-mentioned works are authorised on Sunday only to the extent to which the normal operation of the company does not allow them to be carried out on another day of the week.
The head of the undertaking is required to immediately inform the ITM and the staff committee, if any, of the execution of the works referred to and to forward to it at the same time a list of the employees working on Sunday, the duration of their work and the nature of the work carried out or to be carried out.
