Data Protection in the Context of Personal Data Communication to the ITM
Any employer notifying personal data necessary for the ITM in the exercise of its duties, notably to ensure compliance with legal, regulatory, administrative, and contractual provisions related to working conditions and the protection of employees, acknowledges that these data will be processed by the ITM.
The employer commits to informing its employees and other individuals about the data collected by the ITM.
Within the limits and for the purposes covered by the relevant legal provisions, certain personal data may be disclosed whenever the ITM is legally required to do so, to the Minister responsible for labor, the relevant administrations, judicial authorities, any natural or legal person of private or public law, and any organization and/or expert authorized by the Minister.
The ITM will retain personal data for no longer than is relevant and necessary for the achievement of the objectives for which they are processed.
In accordance with the data protection regulations in force in the Grand Duchy of Luxembourg, the individuals concerned have (i) the right to access, (ii) the right to object unless the data processing is mandatory, (iii) the right to rectification, (iv) the right to erase their data, and (v) the right to restrict processing.
