All establishments featured in the nomenclature are subject to "commodo-incommodo" operating permits that are conditioned and delivered by the Ministry of Labour.
Operating permits for classified establishments stipulate the development and operating conditions that are deemed necessary to protect the environment and ensure the safety of workers, the public and the neighbourhood in general.
The different types of establishments or activities are divided into several classes (1, 1A, 1B, 2, 3, 3A, 3B or 4).
These establishments, previously referred to as dangerous, unsafe or problematic, must receive authorisation based on their classification from:
- the minister responsible for the environment (classes 1B and 3B);
- the minister responsible for labour (classes 1A and 3A);
- the two above-mentioned ministers (classes 1 and 3);
- the mayor of the municipality in question (class 2).
Submission of applications: Commodo e-form
Applicants concerned by classes 1, 1A, 1B, 2, 3, 3A and 3B can complete their application for an operating permit for a classified establishment via a MyGuichet assistant and then print and sign the application before sending it to the competent authorities with the requested annexes.
- 1A and 3A applications must be sent to the Inspectorate of Labour and Mines ,
- 1, 1B, 3 and 3B applications must be sent to the Environment Agency (administration de l’environnement),
- Class 2 applications must be sent to the municipality in question.
Class 4 establishments are governed on the basis of the applicable specific Grand-Ducal Regulation.
The conditions set by ministerial order are either particular operating conditions specific to the project or standard conditions.
New improved version of the "Commodo e-form" MyGuichet assistant
Since the MyGuichet "Commodo e-form" assistant was made available online in July 2017, many users have shared their experience and comments with the Environment Agency and the Inspectorate of Labour and Mines. This extremely constructive information has helped to improve the assistant. Major improvements have been made to:
- the navigation in the "tree structure" menu of the form
- the entry fields (optimisation of entry fields compared to the size of the screen),
- the PDF document generated (PDF page numbering).
The project is subject to continuous development. Feedback from users is welcome.
How is the digital assistant structured?
Following requests from users, the Environment Agency and the Inspectorate of Labour and Mines have drawn up a "Commodo assistant plan" document. This document, which can be downloaded from the Environment Agency and Inspectorate of Labour and Mines website, gives a preview of the structure and the content to be provided in the assistant.
Please note however that the document is only a template of the authorisation request form, it does not represent the official document that needs to be completed!
Why use the assistant?
Given that the structure of the dossier is improved by using the assistant, and the requested information corresponds exactly to the requirements of the authorisation request, applications made via the digital assistant can be processed more efficiently. Our agents are not required to ask for missing additional documents as often or read unnecessary documents when processing an application, for example.
Lastly, the Environment Agency and the Inspectorate of Labour and Mines would like to remind you that the use of the digital assistant will be mandatory once the legislation relating to classified establishments ("commodo" legislation) has been adopted. We recommend new users to start familiarising themselves with the tool as soon as possible.
