D15b4 - How is the 12-month period of posting calculated in the context of the posting of employees engaged in mobile road transport activities?

For the calculation of the duration of twelve months of posting (mentioned in Article L.141-2 of the Labour Code), the posting ends when the mobile employee leaves the national territory in the course of an international operation for the carriage of goods or passengers.

The said period of posting cannot be combined with previous periods of posting worked within the framework of international operations of the kind referred to in the preceding subparagraph by the same mobile employee or by a mobile employee whom he or she replaces.

It should be borne in mind that in the event that the twelve-month period of posting is exceeded, the consequences are those set out in FAQ D15a37.
