D15b1 - Which transport undertakings are covered by the application of the specific rules on posting?

The specific rules relating to mobile road transport activities apply:

  • to undertakings involved in the professional transport of passengers or goods by road and participating in road transport activities;
    • which are covered by Community regulations relating to driving and rest periods, or failing that, by the Law of 6 May 1974 approving the European Agreement concerning the work of crews of vehicles engaged in international road transport (AETR) signed at Geneva on 1 July 1970, or intervening within the framework of bilateral or multilateral agreements giving access to the European Union market or parts of it;
    • established outside the Grand Duchy of Luxembourg;
    • when they temporarily post mobile employees to the national territory.

They are namely applicable when the mobile employee carries out cabotage transport within the meaning of the Regulation (EC) No 1072/2009 of the European Parliament and of the Council of 21 October 2009 on common rules for access to the international road haulage market and of the Regulation (EC) No 1073/2009 on common rules for access to the international market for coach and bus services, and amending Regulation (EC) No 561/2006.
