D15a47 - Which habitability criteria apply to dwellings and rooms rented out or made available for residential purposes by the employer to workers away from their usual place of work?

The area of a room may not be less than 9m² per occupant. A kitchen niche or the space reserved for any sanitary installations which may be present in a room may not be taken into account in the calculation of the prescribed minimum area.

The height of a dwelling, a room or collective facility must be not less than 2.20m, with the exception of any attic part. A dwelling, a room or collective facility existing in an attic must, as regards at least two-thirds of its area, have a clear under-ceiling height of at least 2m. The remainder of its area must have an under-ceiling clear height between 1.80m and 2.00m.

In the case of a dwelling with at least two bedrooms or at least two rooms, the collective facilities must include a fitted kitchen with a minimum area of 8m².

Where there are five occupants or more, the collective facilities must include a living room of a minimum area of 10m², increased by 1.5m² per additional occupant. The said living room, separate from the other rooms, shall not be required where the collective facilities include a fitted kitchen with a minimum area of 13m², increased by 1.5m² for each additional occupant.

The kitchen or living room must have at least 0.75 seating spaces at table per occupant.

All dwellings, rooms or collective facilities must have a heating installation and a compliant electrical installation.

Each room of a dwelling and all collective facilities must be equipped with at least two electrical sockets.

All dwellings or collective facilities must be linked to the collective water supply network and to the existing network for disposal of wastewater. The potable water system is to be designed in such a way as to avoid any bacterial proliferation.

The manager or the owner is required to furnish adequately every furnished room, and the furniture must comprise at least one table and, for each occupant:

  1. a bed with a mattress above floor level;
  2. a chair; and
  3. an individual storage facility for clothing.

Each room must have at least three electrical sockets.

All dwellings, rooms or collective facilities must be equipped with artificial lighting.

Every dwelling is to be fitted with sanitary installations.

Occupants of rooms which do not have private sanitary installations shall have access to common sanitary installations which must be accessible without the need to go outside the building.

Where there are up to six occupants without individual sanitary installations, they must have exclusive access to:

  1. a heated bathroom with a sink and a shower or a bath with a supply of hot and cold water;
  2. a toilet with a sink.

Where there are seven or more occupants without individual sanitary installations, they must have exclusive access to:

  1. a heated bathroom, with a sink and a shower or a bath with a supply of hot and cold water for every six occupants;
  2. a toilet with a sink for every six occupants, and at least half of the toilets must be separate from the bathrooms.

If the toilets are separate from the bathroom, the room must be partitioned up to the ceiling.

The kitchen or the kitchen niche shall be fitted with at least:

  1. a sink-unit equipped with a supply of hot and cold water, fitted with a U-bend and connected to a wastewater disposal system;
  2. three electrical sockets and the required pre-fitting allowing the installation of household equipment, including at least one cooking appliance.

In the event of collective use, the kitchen must include 4 hotplates, and a further 4 hotplates where there are more than ten occupants, a refrigerator and at least 4 electrical sockets, and be provided with mechanical ventilation.
