D15a12 - Do the provisions on the posting of workers apply to all economic sectors?

The provisions concerning the posting of workers apply to all economic sectors, with the exception of undertakings in the merchant navy sector.

Special provisions relating to the posting of workers also apply to undertakings engaged in the professional carriage of passengers or goods by road and involved in road transport activities, covered by Community regulations on driving time and rest periods, or failing that, by the Law of 6 May 1974 approving the European Agreement concerning the work of crews of vehicles engaged in international road transport (AETR) concluded at Geneva on 1 July 1970, or as part of bilateral or multilateral agreements giving access to the European Union market or to parts thereof, and established outside the Grand Duchy of Luxembourg, when they temporarily post mobile employees as defined by Article L.214-2 of the Labour Code to the national territory.

The provisions of the general law concerning posting also apply to transport undertakings for all matters not covered by the specific provisions applicable to these undertakings, to which is referred to above.
