Temporary posting to Luxembourg from abroad

Where an undertaking temporarily posts a worker to Luxembourg, the latter's contract of employment continues to be governed by the law of his/her country of origin.

Nevertheless, there are certain national (Luxembourg) rules, described as matters of public policy by the Labour Code, which are applicable.

By virtue of the principle of favourable treatment, those national public policy provisions are applicable only if they are more favourable for the worker than the foreign provisions.

The posting of a worker to Luxembourg is subject to a posting declaration.
