Period of validity of the collective agreement

The collective agreement is valid from 1 October 2019 to 30 September 2022 inclusive (Article 4).

Personal and material scope

This collective labour agreement applies to all Luxembourg and foreign businesses engaged in the activity of tiling, marble working or stonemasonry working in the territory of the Grand Duchy of Luxembourg, and to their employees whose main activity is carrying out the tiling work listed in Annex 2 to this collective labour agreement.

To that end, this collective labour agreement is concluded subject to the condition precedent to its declaration of general obligation. The collective labour agreement ceases to have effect immediately in the event that the general obligation no longer applies.

Remuneration

Remuneration (Article 4)

The salary period corresponds to 1 calendar month.

  • The statement for the previous month’s salary must be drawn up, and the corresponding amount paid, no later than the 10th day of the following month. If payday coincides with a statutory public holiday, the salary payment must be brought forward to the day before.
  • The monthly salary statement must be accompanied by a payslip indicating the salary period, the number of hours worked, hourly pay and any increases, so that the worker can easily check their salary.
  • In addition, the date of entry into service, the classification group and the leave situation must be indicated on this payslip.
  • Every month, together with the payslip, the employer must provide the employees in question with a detailed statement of the work performed, indicating the respective prices.

Salaries (Article 5)

Professional qualifications and classification (Article 3)

SQ

An employee who has the following tasks as part of their function:

• Demolition

• Delivery of equipment (+ cleaning + works protection)

• Any other work outside the construction site

SQ employees do not carry out any tasks directly or indirectly related to laying, such as (but not limited to) joints, cutting, screed, bonding, etc.

Q2A

An employee who works in training or an employee who carries out laying.

The employee will be employed at qualification level Q2A for a maximum period of 18 months. After this maximum period, the employee in question must automatically advance to qualification level Q2B.

Q2B

An employee who holds a DAP (demande d’admission préalable – preliminary admission application) or an employee at qualification level Q2A who has completed the maximum 18 months of Q2A training.

The employee will be employed at qualification level Q2B for a maximum period of 8 months. After this maximum period, the employee in question must automatically advance to qualification level Q3.

Q3

An employee at qualification level Q2B who has completed the maximum 8 months of Q2B training.

HQ

An employee, in particular a holder of a master’s qualification, who is capable of carrying out all work independently, of assuming additional responsibilities and is capable of leading the business’s teams.

Internal reporting requirement: in the event of a vacant post at qualification level Q2A, the employer must inform the staff delegation or, in the absence of a delegation, all of the business’s employees.

 The sum of fixed-price work, the final salary statement and payment must be made no later than the following month.

After a bill of quantities has been drawn up, the employee must receive a copy of it.

Other remuneration items

Piecework (Article 6)

For tiling, the salary scale for piecework, annexed to this collective labour agreement, must be applied.

Working time

Working hours (Article 9)

The working hours are 8 hours per day and 40 hours per week, spread over 5 working days between Monday and Saturday.

Increases for overtime, night work, and work on Sundays and public holidays (Article 7)

Overtime

Compensatory rest or:

  • up to 10 p.m.: 40%
  • after 10 p.m.: 55%
  • Saturday: 50%

Night work

Between 10 p.m. and 6 a.m.: 15%

Leave entitlement

Annual leave is subject to the provisions of the Labour Code: 26 days

For employees performing mainly piecework (see Annex 2): the leave allowance is paid in the form of a salary supplement amounting to 10.90% of the total gross salary for a year for 25 working days.

Termination of contract

Termination with notice (Article 8)

A permanent employment contract is terminated in accordance with the legal provisions in force.

After termination, management will inform the chair of the delegation or their representative, who must state their opinion within 24 hours. This opinion does not bind management in its final decision. (Article 17)
