D15a46 - Which safety criteria apply to dwellings and rooms rented out or made available for residential purposes by the employer to workers away from their usual place of work?

All dwellings, rooms or collective facilities must meet the safety conditions prescribed by laws or regulations regarding risks of fire, gas and electricity.

All dwellings, rooms or collective facilities must include walls, separating partitions, slabs and ceilings constructed using materials which are of low combustibility or are not combustible. Vertical internal partitions must be fire-resistant for at least 30 minutes.

Vertical movement within a building containing one or more dwellings or rooms must be via a fixed staircase.

Doors, corridors and staircases in a building of that kind must be organised in such a way as to facilitate the rapid and safe evacuation of all occupants.

Occupants must at all times have access to a second emergency exit on the same floor or, for dwellings and rooms authorised by the mayor before the entry into force of the present Regulation, on a floor immediately above or below.

Every evacuation corridor must be of such a size and arranged in such a way that it can be accessed at any time rapidly and in total safety, and must be indicated by standardised symbols conforming to the Grand-Ducal Regulation of 14 November 2016 on the minimum requirements for the provision of safety and/or health signs at work.

For every building of which the area of dwellings and collective facilities exceeds 300m², which has more than three levels or is made up of more than eight rooms, access to the stairwell is to be achieved via fire-break partitions with 60 minutes resistance and fire-break doors with 30 minutes resistance and by smoke-proof partitions and doors. In a building of that kind, the emergency staircases are to be equipped with smoke extraction.

Every building comprising several dwellings or rooms must be equipped with an extinguisher on each floor which is capable of extinguishing fires involving solid and liquid combustible materials. The extinguishers must be installed within reach, be indicated by pictograms and must bear a certificate of control issued by an approved body at least once every two years regarding their condition and proper functioning.

In corridors in which the slabs are of combustible materials and in wooden stairwells, smoke detectors must be installed. The bathroom must be fitted with an autonomous carbon monoxide detector if a gas boiler is installed there.

Where there is a collective kitchen, it must be equipped with a first-aid kit, a heat detector and a six-litre extinguisher appropriate for use against A-B-F grease fires.

Every combustion heating installation and any other means of heating located inside a building containing one or more dwellings or rooms, in which combustion takes place and where the combustion process may release carbon monoxide, are to be connected to a gas-proof and heat-resistant flue and have an adequate input of air.

Where there are fixed installations and movable containers of liquefied petroleum gas, distribution must be effected via metal conduits. Movable containers of liquefied petroleum gas must be located outside the building in a secure enclosure containing no more than two bottles.

All electrical installations are to be designed and protected in such a way that there can be no contact whatsoever between an occupant and the cables of an electrical network.
